Supreme Court ruling on online speech


Elonis v. United States is a case people here should pay attention to. SCOTUS ruled today that the case should be retried in the original lower court.

In his decision, Roberts didn’t rule on the First Amendment aspects of the case. Instead, the Court decided that it wasn’t enough under a federal law to assume that a “reasonable person” would regard the online statements as threatening, but that the law required proof of the defendant’s subjective intent to threaten for conviction.

Given things that have been ‘pissy’ here from time-to-time this should/may be something y’all pay some attention to.
