Fighting a right wing court


The Dems have a tough road to fight the latest GOP right winger nominated to the US Supreme court. A solid conservative majority could shift the court for decades. Of course a Democrat could win as President in 2020 and 2024 which would probably mean some more liberal judges would replace retiring or dead right wingers.

So how to block Brett with only 49 Democrat Senators and all it takes is a majority to approve the nomination?

Dems have a few possible strategies. Brett has written about 300 decisions in 12 years on the DC circuit court. He also had a major role in the Bush White House. Those efforts are fair game for review by the Senators. The Dems can<b> drag </font></b>out the confirmation process.

Another focus will be on the two moderate GOP Senators, Collins and Murkowski. Fear that Brett may overturn Roe v. Wade and the gay marriage decision may cause them to refuse to approve. None of the other conservative judges on the list would be better. But that does not matter.

So the Dems have to delay and then win the Senate to force Trump to nominate a moderate and not a right winger. Not likely but possible.

The hardest hard ball tactic is to refuse to show up and cause the Senate to not have a quorum of 50 Senators. With only 48 or so GOP Senators available on a usual day a total DEM boycott will stop the Senate from functioning. Will the Dems have the discipline to pull off a boycott for months? Dragging out the confirmation until October and then boycotting for a month could work if they can stand the heat. McConnell's mistreatment of Merrick Garland's nomination still rankles. Will the Dems have the strength and fortitude to fight back in equal measure? Stay tuned for the excitement.
